Terms of Service

1. Agreement
Toonzy AI is a Dutch business, registered with the Dutch Chamber of Commerce (KVK) under number 96967633. Registered business address available on request to support@toonzy.app in accordance with Dutch commercial disclosure requirements. These terms govern your use of Toonzy AI. By creating an account you accept them.
2. The service
Toonzy generates short animated videos from text prompts using AI. Output quality varies and is not guaranteed. The service is provided as-is.
3. Your account
You must be at least 16 years old. You are responsible for your account credentials and for all activity under your account. One free trial per person. Creating multiple accounts to obtain additional free renders is a breach of these terms and may result in suspension.
4. Credits
Credits are prepaid units used to render final videos. Generating scripts and storyboards does not consume credits.
A credit is deducted when a render begins. If a render fails for technical reasons on our side, the credit is returned automatically.
Credits are non-transferable, have no cash value, and do not expire.
Unused credits are not refundable except as set out in section 5.
5. Right of withdrawal
If you are a consumer in the EU you normally have 14 days to withdraw from a purchase.
By purchasing credits and using them, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once a credit has been used.
Unused credits may be refunded in full, in US dollars, within 14 days of purchase by emailing support@toonzy.app
6. Your content
You own the ideas you submit and the videos you generate, to the extent permitted by the terms of the underlying AI providers. You may use your videos commercially.
You grant us a limited licence to store and process your content solely to provide the service. We do not use your content to train models.
7. Acceptable use
You may not use Toonzy to create content that is unlawful, defamatory, hateful, sexually explicit, or that harasses or depicts identifiable real people without consent. You may not attempt to generate content involving minors in any sexual or exploitative context. You may not resell access to the service itself.
We may remove content and suspend accounts that breach this section.
8. AI output
AI-generated output may be inaccurate, unexpected, or resemble existing works. You are responsible for reviewing anything you publish. We make no warranty that output is original, accurate, or fit for any particular purpose.
9. Availability
We aim to keep the service running but do not guarantee uptime. We may change, suspend, or discontinue features. If we discontinue the service entirely, unused credits will be refunded.
10. Liability
To the extent permitted by law, our total liability to you is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost revenue or lost content.
Nothing limits liability for death, personal injury, or fraud.
11. Termination
You may close your account at any time. We may suspend or terminate accounts that breach these terms. Unused credits are forfeited on termination for breach.
12. Governing law
These terms are governed by Dutch law, subject to any mandatory consumer protections in your country of residence.
